The United States is planning to implement up to a Visa Visa bond requirement of $ 15,000 for some nationals from countries with high visa tracking interest rates, with the aim of ensuring their departure after short -term business visits to US businesses or tourist visits. This development, according to a recent notice published in the federal register, represents America’s latest approach to address the growing issue of its unauthorized immigrant population and Trump’s administration’s strategy to balance the deterioration of a righteous process.

According to the announcement published in the federal register, the rule of the new bond will apply to applicants from countries who are considered to have a “high interest rate” or “inadequate internal document security”, they may require B-1 or B-2 categories.
The measure aims to prevent possible exaggeration, a demographic that has become quietly a central component of the unauthorized population of US immigrants. Unlike border intersections, these individuals reach legally – often from the air – and remain after the end of their visa.

While images of immigrants crossing the US-Mexico border dominate the news, visa overruns have overcome the illegal border crossings as the main method of entry without documents. In accordance with Pew Research CenterSince 2017, almost two -thirds of the newly acquired unauthorized immigrants have come from countries outside Mexico and Central America, where overruns, not border intersections, are more common. This delicate shift shows why policy makers are now focusing on the visa control mechanisms, including economic deterrents, such as bonds.

Most defenders of the visa are not formal criminals. They often work, increase families and pay taxes, even without legal status. Pew data shows that the growing majority of these immigrants have lived in the US for more than ten years, incorporating the economic and social fabric of American life. Since 2017, over 65% of unauthorized immigrants have been in the US for a decade or more. For Mexican immigrants, this number increased to over 80%.

Many of these people were introduced with valid considerations – such as tourism, study or businesses – and later chose not to leave. Whether incentives for financial opportunities, fear of persecution or family commitments, they are part of a population without documents living in legal uncertainty, facing complex and often punitive consequences.

Consequences of defense: Hidden penalties

The US migration law imposes a strict regime on those who go beyond their authorized visit. These include:

  • Automatic Visa cancellation: Even a one -day route cancels the visa and activates the “consular market bar”, which requires future applications from the country’s nationality country, not neighboring countries such as Canada or Mexico.

Others remain in the care of family members, including the children of citizens or US relatives.

Thirdly, over -excesses are rarely applied through detention or deportation. The US Immigration and Customs (ICE) Organization has limited resources and focuses mainly on criminal relocations. Most hyperinflation remain detectable in the US unless they come into contact with law enforcement.

It is noteworthy that citizens from over 40 mainly European countries benefit from the visa discharge program, allowing up to 90 days of vision. The same is true for Canadians. None of these travelers will face this new rule and will not have to publish a bond. This selective application of the rules can raise questions about justice and human rights, especially if targeted countries come mainly from the world south. By demanding bonds from the Nigerians or Pakistanis, they relieve the Germans and the Australians in danger of reinforcing the perceptions of discrimination.

There are reasonable solutions that could be applied to address the production problem.
